Terms of Service

1. Agreement to Terms
By using any service provided by SiteGenius ("we", "us", "our"), including our website at sitegenius.co.nz, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Services
SiteGenius provides web design, web development, website hosting, and related digital services. Specific deliverables, timelines, and pricing are agreed upon in writing (via email or quote) before work commences.
We reserve the right to decline any project at our discretion.
3. Hosting & Ongoing Services
Where ongoing services (hosting, care plans, email) are arranged separately, the following terms apply:
- →Ongoing services are billed monthly in advance
- →Services may be cancelled with 30 days written notice
- →No refunds are issued for partial months
- →We reserve the right to suspend hosting for accounts overdue by more than 14 days
4. One-Time Projects
For fixed-price project builds:
- →A deposit (typically 50%) is required before work begins
- →The remaining balance is due before the website goes live
- →Deposits are non-refundable once work has commenced
- →Scope changes may incur additional charges
5. Client Responsibilities
To deliver your project on time, you agree to:
- →Provide required content, images, and information in a timely manner
- →Respond to review requests within a reasonable timeframe
- →Ensure all content provided is legally owned or licensed by you
- →Not use our services for any unlawful or harmful purpose
6. Intellectual Property
Upon full payment, you own the website content and design created specifically for you. SiteGenius retains the right to display completed work in our portfolio. We retain ownership of any proprietary tools, code libraries, or frameworks used in development.
7. Limitation of Liability
To the maximum extent permitted by New Zealand law, SiteGenius shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.
8. Uptime and Hosting
We aim for 99.9% uptime on all hosted websites but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. We are not liable for downtime caused by third-party infrastructure providers.
9. Governing Law
These terms are governed by the laws of New Zealand. Any disputes will be resolved under the jurisdiction of New Zealand courts.
